Throughout the site, the terms "we", "us", and "our" refer to ATELIER KELVANE.

ATELIER KELVANE operates this store and website, including all related information, content, features, products, and services (the "Services") to provide you with a curated luxury shopping experience. Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform enabling us to deliver our Services to you.

Please read these Terms of Service ("Terms") carefully. By visiting, browsing, or purchasing from ATELIER KELVANE, you agree to be bound by these Terms and our Privacy Policy.

Section 1 - About ATELIER KELVANE & Independent Decanting

1. Independent Studio: ATELIER KELVANE is an independent fragrance decanting atelier based in the United Arab Emirates. We source genuine fragrances through verified and legitimate supply channels and decant them into our own premium glass atomizers.

2. Brand Non-Affiliation Disclaimer: ATELIER KELVANE is an independent entity and not affiliated with any brand.

  • We are NOT affiliated with, endorsed by, sponsored by, or in partnership with any of the fragrance brands, luxury houses, or designers whose products we decant.
  • All third-party product names, logos, trademarks, and brand imagery displayed on our website are the intellectual property of their respective owners and are used strictly for product identification purposes.

3. Product Integrity: Every fragrance decanted by ATELIER KELVANE is authentic and genuine, sourced from original retail bottles. The fragrance liquid inside our atomizers remains completely unadulterated, unaltered, and undiluted.


Section 2 - Eligibility & Account Responsibilities

By using this site, you confirm that:

  • You are at least 18 years of age, or the age of majority in your jurisdiction.
  • The registration, shipping, and payment details you provide are accurate, complete, and current.
  • You are purchasing products solely for personal or household use, and not for commercial resale or unauthorized export.
  • You are solely responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.


Section 3 - Product Representation & Availability

  • Product Descriptions: We make every effort to display product colors, packaging, and descriptions with accuracy. However, variations in visual display may occur depending on your screen settings.
  • Decant Packaging: Products are delivered in ATELIER KELVANE branded glass atomizers, not the original manufacturer's retail bottle.
  • Availability & Modifications: All items are subject to availability. We reserve the right to limit quantities, discontinue products, or modify pricing without prior notice.


Section 4 - Pricing and Payment

  1. Currency: All prices displayed on the site are listed in UAE Dirhams (AED).
  2. Price Adjustments: Prices are subject to change without notice. The price charged will be the price active at the time your order is submitted and confirmed.
  3. Payment Authorization: By placing an order, you authorize ATELIER KELVANE to charge your provided payment method (Credit/Debit Card, Apple Pay, or other offered payment gateways) for the full total, including shipping and applicable taxes.
  4. Billing Information: You agree to provide current and complete purchase and account information. If a payment fails or is declined, ATELIER KELVANE reserves the right to cancel or suspend order processing.


Section 5 - Orders & Acceptance

Submission of an order constitutes an offer to purchase. An order is only confirmed once you receive an official order confirmation email from ATELIER KELVANE.

We reserve the right to refuse, limit, or cancel any order where reasonably necessary, including orders that:

  • Appear fraudulent, abusive, or placed by unauthorized resellers.
  • Contain pricing or typographical errors.
  • Cannot be fulfilled due to stock limitations or shipping destination restrictions.

If an order is canceled prior to fulfillment, any applicable refund will be processed in accordance with our Return & Refund Policy.


Section 6 - Shipping and Delivery

  • Delivery Estimates: Delivery timeframes provided on the site are estimates only and are not guaranteed. ATELIER KELVANE is not responsible for carrier delays, customs delays, or circumstances beyond our reasonable control.

Section 7 - Returns and Refunds

Due to the hygienic and personal-use nature of fragrance decants, opened, unsealed, sprayed, or used decants are non-returnable and non-refundable.

Fragrance preference or dissatisfaction with the scent itself does not constitute a product defect and is not eligible for return or refund.

Claims relating to damaged, leaking, or incorrect products may be eligible for a replacement, store credit, or refund, subject to review and in accordance with our Return & Refund Policy.


Section 8 - Intellectual Property

All original content on this website including, but not limited to, the ATELIER KELVANE brand name, logos, graphics, text, website layout, packaging design, and photography is the property of ATELIER KELVANE and is protected by applicable copyright and trademark laws.

You are granted a limited license for personal, non-commercial use only. Reproducing, republishing, scraping, or commercializing any content from ATELIER KELVANE without explicit written permission is prohibited.


Section 9 - Customer Feedback & Reviews

If you submit reviews, suggestions, comments, or other marketing material ("Feedback") to ATELIER KELVANE, you grant us a perpetual, worldwide, royalty-free license to publish, edit, translate, and distribute such Feedback across our marketing channels and store.

Feedback must not violate third-party rights, contain illegal or offensive material, or distribute malicious code. We reserve the right to remove user-generated content that violates these standards.


Section 10 - Prohibited Uses & Automated Agents

In addition to standard prohibitions outlined in these Terms, you are prohibited from:

  • Using the site for illegal, fraudulent, or malicious purposes.
  • Circumventing site security measures or transmitting viruses or harmful code.

ATELIER KELVANE is hosted on Shopify Inc. While Shopify provides the infrastructure that powers our online store, commercial transactions, order fulfillment, and product-related obligations are between you and ATELIER KELVANE.

Nothing in these Terms is intended to limit any rights or obligations that cannot legally be excluded under applicable law.


Section 13 - Disclaimer of Warranties

Except as explicitly stated by ATELIER KELVANE, products and services are provided "as is" and "as available", to the extent permitted by applicable law.

Fragrance performance is inherently subject to individual skin chemistry, environmental factors, and personal perception. ATELIER KELVANE does not guarantee that a fragrance will perform identically on all individuals.


Section 14 - Limitation of Liability

To the maximum extent permitted by applicable law, ATELIER KELVANE, its directors, officers, employees, partners, and suppliers shall not be liable for indirect, incidental, punitive, or consequential damages, lost profits, or lost data arising from your use of our products or website.

To the maximum extent permitted by applicable law, ATELIER KELVANE's total liability for a legal claim directly related to a specific order shall not exceed the total amount paid by you for that specific order.


Section 15 - Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless ATELIER KELVANE, its officers, directors, employees, and service providers from third-party claims, losses, liabilities, or reasonable legal expenses arising from your breach of these Terms, misuse of our products, or violation of applicable law or third-party rights.


Section 16 - Severability & Entire Agreement

If any provision of these Terms is determined to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be severed or limited to the extent necessary without affecting the validity and enforceability of the remaining provisions.

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the agreement between you and ATELIER KELVANE regarding your use of our Services and purchases from our store.


Section 17 - Governing Law & Jurisdiction

These Terms of Service and any separate purchase agreements shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Any legal dispute or claim arising out of or relating to your use of this site or purchases from ATELIER KELVANE shall be subject to the jurisdiction of the competent courts of the United Arab Emirates, subject to any mandatory jurisdictional rights under applicable law.

القسم الأول - عن أتيلييه كيلفان وتعبئة العطور المستقلة

    ١. الاستوديو المستقل: أتيلييه كيلفان هو استوديو مستقل لإعادة تعبئة العطور، مقره في دولة الإمارات العربية المتحدة. نقوم بتوفير العطور الأصلية من خلال قنوات توريد موثوقة وشرعية، ثم نعيد تعبئتها في زجاجات البخاخ الزجاجية الفاخرة الخاصة بنا.

    ٢. إخلاء مسؤولية عدم التبعية للعلامات التجارية: أتيلييه كيلفان كيان مستقل وغير تابع لأي علامة تجارية.

    • لسنا تابعين أو معتمدين أو مدعومين أو برعاية أو في شراكة مع أي من العلامات التجارية للعطور أو دور العطور الفاخرة أو المصممين الذين نقوم بإعادة تعبئة منتجاتهم.
    • جميع أسماء المنتجات والشعارات والعلامات التجارية والصور الخاصة بالعلامات التجارية التابعة لأطراف ثالثة والمعروضة على موقعنا هي ملكية فكرية لأصحابها، وتُستخدم حصراً لغرض التعريف بالمنتج.

    ٣. سلامة المنتج: كل عطر تتم إعادة تعبئته بواسطة أتيلييه كيلفان هو عطر أصلي وحقيقي، ويتم الحصول عليه من زجاجات العطور الأصلية المخصصة للبيع بالتجزئة. ويبقى السائل العطري داخل زجاجاتنا دون أي تحريف أو تغيير أو تعديل أو تخفيف.


    القسم الثاني - أهليّة الاستخدام ومسؤوليات الحساب

    :باستخدامك لهذا الموقع، فإنك تؤكد ما يلي

    • أنك تبلغ من العمر 18 عاماً على الأقل، أو بلغت سن الأهلية القانونية في نطاقك القضائي.
    • أن بيانات التسجيل والشحن والدفع التي تقدمها دقيقة وكاملة وحديثة.
    • أنك تشتري المنتجات حصرياً للاستخدام الشخصي أو المنزلي، وليس لإعادة البيع التجاري أو التصدير غير المصرح به.

    القسم الثالث - عرض المنتجات وتوفرها

    • وصف المنتجات: نبذل قصارى جهدنا لعرض ألوان المنتجات وعبواتها وأوصافها بدقة. ومع ذلك، قد تحدث اختلافات في العرض البصري اعتماداً على إعدادات شاشة جهازك.
    • عبوات العطور: تُسلّم المنتجات في زجاجات بخاخ زجاجية تحمل علامة أتيلييه كيلفان التجارية، وليس في زجاجة الشركة المصنعة الأصلية.
    • التوفر والتعديلات: جميع المنتجات خاضعة للتوفر في المخزون. ونحتفظ بالحق في تحديد الكميات أو إيقاف المنتجات أو تعديل الأسعار دون إشعار مسبق.


    القسم الرابع - الأسعار والدفع

    • ١ العملة: جميع الأسعار المعروضة على الموقع مدونة بالدرهم الإماراتي.
    • ٢ تعديل الأسعار: الأسعار قابلة للتغيير دون إشعار مسبق. والسعر الذي يتم احتسابه هو السعر الساري عند إرسال الطلب وتأكيده.
    • ٣ تفويض الدفع: بإتمام الطلب، فإنك تفوض أتيلييه كيلفان بخصم إجمالي المبلغ من وسيلة الدفع التي قدمتها، بما في ذلك رسوم الشحن والضرائب المطبقة.
    • ٤ معلومات الفوترة: تتعهد بتقديم معلومات شراء وحساب حديثة وكاملة. وفي حال فشل عملية الدفع أو رفضها، يحتفظ أتيلييه كيلفان بالحق في إلغاء أو تعليق معالجة الطلب.


    القسم الخامس - الطلبات وقبولها

    يُعد إرسال الطلب بمثابة عرض للشراء، ولا يُعتبر الطلب مؤكداً إلا بعد استلامك رسالة بريد إلكتروني رسمية لتأكيد الطلب من أتيلييه كيلفان.

    نحتفظ بالحق في رفض أو تحديد أو إلغاء أي طلب عند وجود سبب مبرر لذلك، بما في ذلك الطلبات التي:

    • تبدو احتيالية أو مسيئة أو مقدمة من موزعين غير مصرح لهم.
    • تحتوي على أخطاء في الأسعار أو أخطاء مطبعية.
    • يتعذر تنفيذها بسبب قيود المخزون أو قيود وجهة الشحن.

    في حال إلغاء الطلب قبل دخوله مرحلة التجهيز، تتم معالجة أي مبلغ مسترد وفقاً لسياسة الإرجاع والاسترداد الخاصة بنا.


    القسم السادس - الشحن، التسليم

    • تقديرات التسليم: أوقات التسليم الموضحة على الموقع هي تقديرات فقط وليست مضمونة. لا يتحمل أتيلييه كيلفان المسؤولية عن تأخيرات شركات الشحن أو الإجراءات الجمركية أو الظروف الخارجة عن سيطرتنا المعقولة.
    • سياسة الشحن: لمعرفة أسعار الشحن وجداول التسليم والحدود المتعلقة بالشحن بالتفصيل، يرجى مراجعة سياسة الشحن المخصصة.


    القسم السابع - الإرجاع والاسترداد

    نظراً للطبيعة الشخصية لاستخدام العطور، فإن العينات العطرية التي تم فتحها أو إزالة ختمها أو رشها أو استخدامها غير قابلة للإرجاع أو الاسترداد.

    كما أن عدم الإعجاب بالرائحة أو عدم ملاءمتها للتفضيل الشخصي لا يُعد عيباً في المنتج ولا يؤهل للإرجاع أو استرداد المبلغ.

    أما المطالبات المتعلقة بالمنتجات التي تصل تالفة أو متسربة أو غير مطابقة للطلب، فقد تكون مؤهلة للاستبدال أو الحصول على رصيد متجر أو استرداد المبلغ، وذلك بعد المراجعة ووفقاً لسياسة الإرجاع والاسترداد الخاصة بنا.


    القسم الثامن - الملكية الفكرية

    جميع المحتويات الأصلية على هذا الموقع، بما في ذلك على سبيل المثال لا الحصر اسم علامة أتيلييه كيلفان التجارية، والشعارات، والرسومات، والنصوص، وتصميم الموقع، وتصميم العبوات، والصور الفوتوغرافية، هي ملكية أتيلييه كيلفان ومحمية بموجب قوانين حقوق الطبع والنشر والعلامات التجارية المعمول بها.

    يجب ألا تنتهك الملاحظات حقوق أي طرف ثالث، وألا تحتوي على مواد غير قانونية أو مسيئة، وألا تتضمن برمجيات خبيثة. ونحتفظ بالحق في حذف أي محتوى من إنشاء المستخدم يخالف هذه المعايير.


    القسم العاشر - الاستخدامات المحظورة والبرمجيات الآلية

    :بالإضافة إلى الاستخدامات المحظورة الموضحة في هذه الشروط، يُمنع منعاً باتاً

    • استخدام الموقع لأغراض غير قانونية أو احتيالية أو ضارة.
    • التحايل على التدابير الأمنية للموقع أو إرسال الفيروسات أو البرمجيات الضارة.
    • استخراج البيانات أو نسخ المحتوى أو استخدام الأنظمة الآلية أو الروبوتات لجمع البيانات دون تصريح.
    • تشغيل برمجيات آلية أو وكلاء ذكاء اصطناعي بهدف التحايل على التدابير الأمنية أو تجاوز اختبارات التحقق أو انتحال هوية المستخدمين أو التدخل في تشغيل الموقع أو أمنه.

    قد تؤدي أي مخالفة إلى إنهاء الوصول إلى الحساب، واتخاذ الإجراءات القانونية عند الاقتضاء.

    قد نوفر إمكانية الوصول إلى أدوات وبوابات دفع وروابط خارجية لأطراف ثالثة لا نملك سيطرة مباشرة عليها. وتقر بأن الوصول إلى هذه الأدوات يتم "كما هو" و"حسب المتاح". ولا يتحمل أتيلييه كيلفان المسؤولية عن المشكلات الناتجة عن استخدامك لأدوات أو روابط الأطراف الثالثة الاختيارية، وذلك إلى الحد الذي يسمح به القانون المعمول به.


    القسم الثاني عشر - حوكمة المنصة والعلاقة مع شوبيفاي

    متجر أتيلييه كيلفان مستضاف على منصة شوبيفاي. وبينما توفر شوبيفاي البنية التحتية التي تدعم متجرنا الإلكتروني، فإن المعاملات التجارية وتجهيز الطلبات والالتزامات المتعلقة بالمنتجات تتم بينك وبين أتيلييه كيلفان.

    ولا يهدف أي نص في هذه الشروط إلى تقييد أي حقوق أو التزامات لا يجوز استبعادها قانوناً بموجب القوانين المعمول بها.


    القسم الثالث عشر - إخلاء مسؤولية الضمانات

    باستثناء ما هو منصوص عليه صراحة من قبل أتيلييه كيلفان، تُقدم المنتجات والخدمات "كما هي" و"حسب المتاح"، وذلك إلى الحد الذي يسمح به القانون المعمول به.

    يتأثر أداء العطور بطبيعة كيمياء البشرة والعوامل البيئية والانطباع الشخصي. ولذلك لا يضمن أتيلييه كيلفان أن يعمل العطر بنفس الطريقة أو بنفس مستوى الثبات على جميع الأشخاص.


    القسم الرابع عشر - تحديد المسؤولية

    إلى الحد الأقصى الذي يسمح به القانون، لا يتحمل أتيلييه كيلفان أو مديروه أو مسؤولوه أو موظفوه أو شركاؤه أو موردوه المسؤولية عن أي أضرار غير مباشرة أو عرضية أو تأديبية أو تبعية، أو خسارة في الأرباح أو البيانات، ناتجة عن استخدامك لمنتجاتنا أو موقعنا.

    وإلى الحد الأقصى الذي يسمح به القانون، لا تتجاوز المسؤولية الإجمالية لأتيلييه كيلفان عن أي مطالبة قانونية مرتبطة مباشرة بطلب محدد إجمالي المبلغ الذي دفعته مقابل ذلك الطلب.


    القسم الخامس عشر - التعويض

    إلى الحد الذي يسمح به القانون، توافق على تعويض أتيلييه كيلفان ومسؤوليه ومديريه وموظفيه ومقدمي الخدمات التابعين له وحمايتهم من مطالبات الأطراف الثالثة أو الخسائر أو المسؤوليات أو المصاريف القانونية المعقولة الناشئة عن انتهاكك لهذه الشروط، أو سوء استخدامك لمنتجاتنا، أو انتهاكك لأي قانون معمول به أو أي حق من حقوق الأطراف الثالثة.


    القسم السادس عشر - قابلية الفصل وإجمالي الاتفاق

    في حال ثبوت أن أي حكم من أحكام هذه الشروط غير قانوني أو باطل أو غير قابل للنفاذ من قبل محكمة مختصة، يتم فصل ذلك الحكم أو تقييده بالقدر اللازم، دون أن يؤثر ذلك على صحة ونفاذ باقي الأحكام.

    تشكل هذه الشروط، إلى جانب سياسة الخصوصية وسياسة الشحن وسياسة الإرجاع والاسترداد، الاتفاق بينك وبين أتيلييه كيلفان فيما يتعلق باستخدامك لخدماتنا وعمليات الشراء من متجرنا.


    القسم السابع عشر - القانون الساري والنطاق القضائي

    تخضع شروط الخدمة هذه وأي اتفاقيات شراء منفصلة للقوانين السارية في دولة الإمارات العربية المتحدة وتُفسر وفقاً لها.

    وتخضع أي نزاعات أو مطالبات قانونية تنشأ عن استخدام هذا الموقع أو عمليات الشراء من أتيلييه كيلفان للاختصاص القضائي للمحاكم المختصة في دولة الإمارات العربية المتحدة، مع مراعاة أي حقوق إلزامية للاختصاص القضائي يقررها القانون المعمول به.
